North Kohala Tool Library

1.      Members must be 18 years old  or over to borrow and use tools from the North Kohala Tool Library (“NKTL”.)

2.     Only the Member is authorized to use NKTL tools. The Member shall not permit the use of items checked out to him or her by any other person.

3.     NKTL staff may be available to assist in explaining the operation of tools.  However, by taking possession of any item, the Member is certifying that he or she is capable of using that item in a safe and proper manner. The Member agrees to reference the user manual (available online) of the tool for any necessary reason.

4.    NKTL may or may not loan Personal Safety Equipment (PSE) required or recommended to use with tools. Member agrees to obtain and use all recommended or required PSE while operating any of NKTL's tools.

5.     Tools may only be returned during NKTL’s business hours. All tools borrowed are to be returned to NKTL by close of business on their due date.

 6.     If a tool is returned late, the Member will be responsible for late fees.  Late fees are capped at the value of the tool plus a $10 administrative fee per tool.  If a tool is 60 days late, membership is permanently revoked. NKTL may replace severely delinquent tools, holding the Member responsible for the full replacement cost plus the $10 administrative fee.  Fines must be paid in full before borrowing additional items.

7.     NKTL reserves the right to use appropriate steps to retrieve delinquent tools or unpaid fines and fees, including the use of a card on file, collection agency and/or legal action. The Member will be responsible for all associated costs of such.  NKTL also reserves the right to forgive fees due to special circumstances.

8.     All tools are to be returned in the same or better condition as they were issued, barring normal wear and tear.  All tools must be returned clean.  The Member agrees to pay for the loss or damage of any item and further agrees to accept NKTL’s assessment of condition of items and further agrees to NKTL’s assessment of fair restitution for damage, dirtiness, delinquency, and/or loss of items in part or in total.  This restitution amount could equal the full replacement cost of the item plus the $10 administrative fee. A minimum of $5 Cleaning Fee will be charged for every item that's returned dirty as per NKTL staff assessment of conditions.

9.     Members may ask to renew each tool once if they contact NKTL prior to the due date; however, NKTL reserves the right to refuse or limit renewals and will do so based on demand. If renewal acceptance is not received, member must return the tool on the original due date, or pay any late penalty fees if returning at a later time. 

10.     Please notify NKTL staff if an item needs maintenance.

11.     The Member agrees that NKTL is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.

12.   The Member agrees that if any borrowed tool becomes unsafe or in a state of disrepair, he or she must immediately discontinue use of the tool and notify NKTL of the issue upon return, if not earlier.

13.   NKTL reserves the right to refuse the loan of any item at its discretion.

14.   Prior to borrowing tools, all Members must (a) create an account; (b) sign the Waiver and Indemnification Form; (c) have their residence confirmed by a NKTL volunteer or staff member; (d)  a credit/debit card to use as payment method.  Identity is confirmed by presenting a valid government issued photo ID.

15.   I affirm that the information that I have provided on the Membership Application is current, true and correct. I understand that this information may be subject to verification. I further state that I have read and fully understand the rules and regulations of the North Kohala Tool Library, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.

16.   I agree to read and sign the North Kohala Tool Library Member Waiver, Release and Indemnification Agreement

I state that I am capable and experienced in using the tools I am borrowing, and that I will use the tools I am borrowing in a proper manner.

I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against North Kohala Tool Library (NKTL), its officers, agents, employees, and volunteers for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from the North Kohala Tool Library.

I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless North Kohala Tool Library, its officers, agents, employees and volunteers from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from the North Kohala Tool Library. I am aware that North Kohala Tool Library, its partners, directors, officers, members, and employees claim no expertise and make no representation concerning the fitness of any tool for any particular use.
